In practice, a trademark becomes an asset - an element with real market value that can be licensed, sold or incorporated into a company's investment strategy.
What is a trademark?
A trademark is a designation that distinguishes the goods or services of one entrepreneur from those of others on the market. These are most often words, logos, or graphics, but the law also allows for sound, spatial, color, and multimedia marks.
In practice, a trademark is one of the most important elements of a brand - its "legal core" - while a brand also encompasses marketing, communication and visual aspects.
Trademark as a company asset
The valuations of the world's largest brands show how important the protection of intellectual property is - Apple's logo was estimated at over $214 billion , and Coca-Cola's at over $60 billion.
How long is protection provided for?
Trademark protection is granted for 10 years from the date of filing and can be extended for subsequent periods without limitation. This means that a properly managed trademark can protect a brand throughout the life of the company.
Trademark registration process in Poland (UPRP)
The first step is to check whether the mark can be registered and whether it does not infringe the prior rights of other entities.
At this stage, we determine which brand element is to be protected, what type of trademark we are applying for, and we also choose the scope of protection.
Applications can be submitted online via the ePUAP system or the UPRP platform, or traditionally. The application fee is also paid at this stage.
An approved application is published in the Public Information Bulletin (BUP). From that point, third parties have three months to object to the registration.
If no objection is filed, the Polish Patent Office issues a decision granting protection. From that moment on, the mark is legally protected.
