Protect your brand

Trademark registration

Building a recognizable brand is a key element of business development, but only formal trademark registration provides real legal protection. This allows you to exclusively use the mark, respond to infringements, and build a competitive advantage that cannot be undermined by marketing alone.

In practice, a trademark becomes an asset - an element with real market value that can be licensed, sold or incorporated into a company's investment strategy.

What is a trademark?

A trademark is a designation that distinguishes the goods or services of one entrepreneur from those of others on the market. These are most often words, logos, or graphics, but the law also allows for sound, spatial, color, and multimedia marks.

In practice, a trademark is one of the most important elements of a brand - its "legal core" - while a brand also encompasses marketing, communication and visual aspects.

Trademark as a company asset

A successfully registered trademark has real economic value. It can:
To be sold
Be valued as an asset
To form the basis of a license
To be an investment hedge

The valuations of the world's largest brands show how important the protection of intellectual property is - Apple's logo was estimated at over $214 billion , and Coca-Cola's at over $60 billion.

How long is protection provided for?

Important

Trademark protection is granted for 10 years from the date of filing and can be extended for subsequent periods without limitation. This means that a properly managed trademark can protect a brand throughout the life of the company.

Trademark registration process in Poland (UPRP)

Five key steps to successfully securing brand protection
1
Preliminary examination

The first step is to check whether the mark can be registered and whether it does not infringe the prior rights of other entities.

2
Selecting the scope of protection and preparing the application

At this stage, we determine which brand element is to be protected, what type of trademark we are applying for, and we also choose the scope of protection.

3
Submitting an application for registration with the Polish Patent Office

Applications can be submitted online via the ePUAP system or the UPRP platform, or traditionally. The application fee is also paid at this stage.

4
Verification procedure and publication in the UPRP Bulletin

An approved application is published in the Public Information Bulletin (BUP). From that point, third parties have three months to object to the registration.

5
Decision on registration and obtaining a protection certificate

If no objection is filed, the Polish Patent Office issues a decision granting protection. From that moment on, the mark is legally protected.

How do we support entrepreneurs?

Trademark registration is a multi-stage process: from risk analysis, through filing, to overseeing protection and responding to infringements. Successfully completing these stages requires specialized knowledge, familiarity with EUIPO/UPRP practice, and experience in pre-litigation and court proceedings.

That's why we offer our clients comprehensive support, including:

1
Examination of the registrability of a trademark

The first step is to assess whether the selected designation is even eligible for registration—and whether there are any prior rights that could block the process. We analyze conflicts and risks, and create recommendations regarding the scope of registration.

2
Trademark registration in Poland, the EU and WIPO

We process applications with the Polish Patent Office (UPRP) (Poland), the European Union Patent Office (EUIPO), and the International Protection Agency (WIPO). We prepare classifications for goods and services, prepare documentation, and monitor the entire process until a certificate is issued.

3
Support in obtaining funding (SME Fund)

Our lawyers are listed as IP Scan providers – a diagnostic service that can be subsidized by up to 90% under the EUIPO's SME Fund program. We assist with conducting the research, preparing documents, and submitting the grant application.

4
Post-registration protection and breach response

A registered trademark provides effective tools for combating unfair competition—from opposing subsequent applications to legal action. We represent clients in negotiations, opposition proceedings, and infringement disputes.
