the foundations of compliance in e-commerce
E-commerce law
Online commerce is growing faster than any other sector of the economy, and as it grows, the regulations surrounding it become increasingly complex. Many people ask whether "e-commerce law" is a separate field of law. However, the answer is clear: there is no single piece of legislation that encompasses e-commerce law.
This is why it is so crucial to work with a specialized team of lawyers who not only know the regulations regarding online sales, but also understand the specifics of the industry itself.
What is e-commerce law?
E-commerce law is a set of regulations that impact every stage of an online store's operation—from preparing documentation, through offer presentation and the sales process, to after-sales service and product and data security. Therefore, it is not a single branch of law, but a practical compilation of standards that create a framework for digital sales.
These include disclosure obligations under the Consumer Rights Act, price display rules under the Omnibus Directive, product safety requirements under the GPSR, and regulations for online platforms under the Digital Services Act. Together, they create a system in which entrepreneurs must not only be familiar with the regulations but also understand the interrelationships between them.
This is why most problems in e-commerce do not stem from a lack of documentation, but from a lack of consistency - the regulations do not correspond to what the customer sees, the interface is misleading, and the purchasing process does not meet the information obligations.
The most important regulations shaping e-commerce
The Consumer Rights Act defines the rules for conducting sales to consumers and businesses with consumer rights. It regulates the requirement to provide price, shipping costs, processing time, information on the right of withdrawal, complaints, and all other elements that must be included in the purchasing process.
Omnibus introduced rules for presenting promotions, an obligation to disclose the lowest price in the last 30 days, and rules for verifying customer reviews. This regulation directly impacts how offers are communicated, campaigns are run, and interface design.
If the process has not been adapted, any discount mechanism can generate a real risk of sanctions.
The DSA regulates the operation of online platforms, including systems for publishing opinions and comments. It regulates the removal of illegal content, the transparency of algorithms, and the identification of sellers on marketplaces.
This is particularly important for companies operating in the platform and marketplace model.
The GPSR introduces comprehensive safety obligations for products available on the European market, including those sold online. This applies to both consumer products and those originally intended for professional use but later sold to individual consumers.
The regulation sets out rules for product recalls, reporting hazards and conducting due diligence processes.
Why is the support of an e-commerce legal team crucial?
Selling online means operating in an environment governed by numerous, frequently changing regulations. Every element of a store's operation—from product presentation, through the purchasing process, to customer communication—has specific legal implications. In practice, this means that the entrepreneur not only sells but also fulfills a range of obligations arising from national and EU regulations.
Collaborating with a team of lawyers allows you to organize these areas and understand the interrelationships between regulations that, at first glance, seem disparate. Professional support allows you to identify risks before they cause real problems and ensures consistency between documentation, store operations, and the user experience. It's also a way to avoid common mistakes, which in e-commerce are most often caused not by a lack of good will, but by a lack of awareness of detailed requirements.
