Regulations of the ecommercelegal.pl online store

 

These Regulations contain the rules of operation of the ecommercelegal.pl store through which you, as an entrepreneur, can directly purchase some of the services we provide.

Here you will find, in particular, information about our services, the rules for placing orders, the right to withdraw from the contract and liability for non-conformity of the service with the contract.

 

§ 1. Definitions

Shop – online store located at ecommercelegal.pl

Ecommerce.legal – ecommerce.legal a limited liability company with its registered office in Poznań (60-529) at 77A Dąbrowskiego Street, entered into the register of entrepreneurs of the National Court Register by the District Court Poznań – Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the KRS under the number: 0001071438, NIP: 7812061024, REGON: 527034850, share capital: 10,000.00, telephone number +48 530 091 988, e-mail address: biuro@ecommercelegal.pl .

Customer – a natural person conducting business activity, a legal person or an organizational unit without legal personality, to which the applicable law grants legal capacity, concluding an Agreement with Ecommerce.legal.

Entrepreneur with consumer rights - a natural person concluding a contract with Ecommerce.legal directly related to his/her business activity, when the content of this contract indicates that it is not of a professional nature for this person, resulting in particular from the subject of the business activity performed by him/her, made available on the basis of the provisions on the Central Register and Information on Business Activity.

Consumer Rights Act - Act of 30 May 2014 on consumer rights.

Agreement – ​​a service agreement, a digital services agreement or a digital content sales agreement concluded between the Client and Ecommerce.legal.

Service – service, digital service or digital content that is the subject of the Agreement.

User – Customer or recipient of services provided by Ecommerce.legal.

Ecommerce.legal data – Ecommerce.legal contact details, in particular for complaints and returns: ecommerce.legal, a limited liability company, with its registered office in Poznań (60-529) at 77A Dąbrowskiego Street, entered into the register of entrepreneurs of the National Court Register by the District Court Poznań – Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the KRS under the number: 0001071438, NIP: 7812061024, REGON: 527034850, share capital: PLN 10,000.00, telephone number +48 530 091 988, e-mail address: biuro@ecommercelegal.pl .

Newsletter – a service provided by the Store to the User, consisting in sending him/her all information about the Store’s activities, after the User voluntarily provides his/her e-mail address, name and surname.

 

§ 2. Introductory provisions

1.     These regulations define the rules of using the online store located at ecommercelegal.pl and the rules and procedure for concluding sales contracts and contracts for the provision of distance services via the Store.

3.     The Regulations are available continuously on the ecommercelegal.pl website in a way that allows their downloading, reproduction and recording of their content by printing or saving on a medium at any time.

4.     Making purchases in the Store requires access to a computer or mobile device with internet access, a web browser that supports JavaScript and necessary cookies, and email. Furthermore, completing the ordering process requires providing the data necessary to complete the order.

5.     Ecommerce.legal employs a transparent pricing policy. If a price reduction is announced, the previous (crossed-out) price is always the lowest price from the 30-day period prior to the price reduction, in accordance with Article 4, Section 2 of the Act of 9 May 2014 on Information on the Prices of Goods and Services.

 

§ 3. Customer Account

1.     Purchases in the Store are made without the Customer account registration process.

2.     Ecommerce.legal provides the User with access to the Customer Account via the Store.

3.     Access to the Customer Account is possible after logging in – for this purpose, the customer:

1)     declares that he/she has read the Regulations and Privacy Policy of the store;

2)     provides the e-mail address provided by him/her;

3)     enters the access code sent to the e-mail address provided by the Customer in the field provided for this purpose.

4.     After logging in, the User has access to the Customer Account.

 

§ 4. Making purchases in the Store

1.     Ecommerce.legal offers through the Store:

1)     the possibility of concluding a subscription agreement for legal services;

2)     the possibility of concluding a contract for one-time legal services;

3)     sales of digital products;

4)     sale of digital services.

2.     The rules for concluding subscription agreements for legal services and their terms and conditions are included in the subscription regulations available here .

3.     The net price of the service is given on the Store's website.

4.     Information about services provided on the Store's website, in particular their descriptions, technical and operational parameters and prices, constitute an invitation to conclude a contract, within the meaning of Article 71 of the Civil Code.

5.     After selecting the product, the Customer should follow the instructions displayed on the Store's website to complete the purchase. If they have a discount code, they can enter it in the shopping cart or during the ordering process. The Customer can then calculate the cart costs and proceed to payment.

6.     To place an order, the Customer must provide data marked as mandatory in the forms. Until the Customer clicks the "Complete Order" button, the Customer can modify the order or the data provided.  

7.     To finalize your order, the Customer must place the order by clicking the "Pay Now" button on the order summary page. To place an order, you must first add items to your cart, provide your details, and provide the required consents, including acceptance of the terms and conditions.  

8.     After placing an order, Ecommerce.legal immediately confirms its receipt and simultaneously accepts the order for processing. Ecommerce.legal sends the Customer an email to the email address provided during the order placement process. The email contains, at a minimum, a statement from Ecommerce.legal confirming receipt of the order and its acceptance for processing, as well as confirmation of the conclusion of the Agreement. Upon receipt of the above email by the Customer, an Agreement is concluded between the Customer and Ecommerce.legal.

9.     Ecommerce.legal is not responsible for any disruptions in the operation of the Store that may be caused by the lack of compatibility of the Store with the devices used by the Customer, force majeure, unauthorized actions of third parties or technical faults on the part of the providers of certain services.

10.  Ecommerce.legal reserves the right to suspend order processing if there are reasonable doubts as to the accuracy and reliability of the data entered by the Customer in the forms. In such a situation, the store will contact the Customer immediately.

11.  Ecommerce.legal undertakes to perform the service referred to in paragraph 1 point 2) no later than within 30 days from the date of payment for the order or, if such functionality is made available, within the time specified in the calendar available in the ordering process.

12.  Details regarding the provision of the service will be included in the e-mail after payment of the order and will be, if necessary, further specified by Ecommerce.legal and the Client, taking into account the Client's needs.

 

§ 5. Payment methods

1.     The Store accepts payment methods available during the ordering process. Ecommerce.legal specifically provides the following payment methods:

and)     payment card;

b)     electronic payment via Przelewy24, operated by PayPro SA in Poznań, 60-198 Poznań, ul. Pastelowa 8, entered into the Register of Entrepreneurs  maintained by the District Court for Poznań Nowe Miasto and Wilda, 8th Commercial Division of the National Court Register under KRS number 0000347935. 2.     If the Customer chooses to pay by card or electronic payments, the Customer is obliged to make the payment within 5 business days from the date of conclusion of the Agreement.

3.     The customer consents to the sending of invoices in electronic form.

 

§ 6. Non-conformity of Services with the Contract and Complaints

1.     The basis and scope of Ecommerce.legal's liability towards the Entrepreneur under consumer rights is defined by generally applicable legal provisions, in particular the Consumer Rights Act. Ecommerce.legal hereby informs about the entrepreneur's liability for the performance of services in accordance with the contract, as provided by law.

2.     Ecommerce.legal undertakes to provide legal services with due diligence and based on the latest available knowledge.

3.     Complaints should be submitted in writing or electronically to the Ecommerce.legal addresses provided in these Terms and Conditions. When filing a complaint, the Customer should provide their: first and last name, address, order identification information (e.g., order number), the subject and reason for the complaint, the Customer's request, and contact information. Ecommerce.legal's contact details for complaints can be found in § 1 of these Terms and Conditions.

4.     Digital content or a digital service is in conformity with the contract if, in particular, its:

1)     description, type, quantity, quality, completeness, functionality, compatibility, interoperability and availability of technical support and updates;

2)     suitability for a specific purpose for which they are required by the Consumer Entrepreneur, of which the Consumer Entrepreneur informed the entrepreneur no later than at the time of conclusion of the Agreement and which the entrepreneur accepted. If the goods are inconsistent with the agreement, the Consumer Entrepreneur may demand that the defects be repaired or removed.

5.     In cases specified in the Consumer Rights Act, a Trader acting as a consumer may submit a declaration of price reduction or withdrawal from the contract. This applies in particular to situations where Ecommerce.legal has refused to bring the service into conformity with the contract or has failed to bring the service into conformity with the contract.

6.     Ecommerce.legal shall refund to the Entrepreneur with consumer rights the amounts due as a result of exercising the right to reduce the price immediately, no later than within 14 days from the date of receipt of the declaration of the Entrepreneur with consumer rights on the price reduction.

7.     In the event of withdrawal from the contract, Ecommerce.legal, after accepting the complaint, shall refund the price to the Entrepreneur as a consumer immediately, no later than within 14 days from the date of receipt of the declaration of withdrawal from the contract.

8.     A trader with consumer rights may not withdraw from a contract if the lack of conformity of the service with the contract is immaterial. It is presumed that the lack of conformity of the service with the contract is material.

9.     Ecommerce.legal is liable for any lack of conformity with the contract of digital content or digital services delivered on a one-off basis or in parts, which existed at the time of delivery and became apparent within two years of that time. Any lack of conformity of digital content or digital services with the contract that becomes apparent within one year of delivery of the digital content or digital service is presumed to have existed at the time of delivery.

10.  Ecommerce.legal is obliged to respond to the Entrepreneur's complaint under consumer rights within 14 days of its receipt.

11.  If a warranty is provided for the product, information about it and its content will be included in the description of the service in the Store. Deviating from the warranty terms specified in the advertisement to the detriment of the entrepreneur and consumer rights is ineffective unless the warranty statement made in the advertisement before the conclusion of the contract has been corrected in accordance with the conditions and form in which the advertisement was made, or in a comparable manner.

 

§ 7. Right to withdraw from the contract

1.     Pursuant to the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827), a Customer who is an Entrepreneur with consumer rights has the right to withdraw from a distance contract without giving any reason within 14 days.

2.     In order to meet the deadline referred to in paragraph 1, it is sufficient to send the declaration of withdrawal before its expiry.

3.     The recommended form of submitting a declaration of withdrawal from the contract is to send it to the e-mail address biuro@ecommercelegal.pl.

4.     Ecommerce.legal will immediately confirm receipt of the declaration.

5.     In the event of effective withdrawal from a distance sales contract, it is deemed not to have been concluded.

6.     Ecommerce.legal will refund all payments received immediately, and in any event no later than 14 days from the day on which it was informed of the decision to exercise the right to withdraw from this contract. Refunds will be made using the same payment method used in the original transaction, unless the Consumer Entrepreneur has expressly agreed otherwise. In any case, the Consumer Entrepreneur will not incur any fees in connection with this refund.

7.     Withdrawal from a distance contract does not apply to contracts for the supply of digital content not supplied on a tangible medium for which the consumer is obliged to pay the price if Ecommerce.legal commenced the performance with the express and prior consent of the Entrepreneur acting as a consumer, who was informed before the commencement of the performance that after the performance by Ecommerce.legal he would lose the right to withdraw from the contract and acknowledged this, and Ecommerce.legal provided the Entrepreneur acting as a consumer with confirmation of the conclusion of the distance contract on a tangible medium within a reasonable time after its conclusion.

 

§ 8. Provision of services by electronic means

1.     Ecommerce.legal takes steps to ensure the proper operation of the Store, to the extent resulting from current technical knowledge, and undertakes to remove any irregularities reported by Users using the Ecommerce.legal Data within a reasonable time.

2.     If you wish to file a complaint, the User should provide his/her name and surname, correspondence address, type and date of occurrence of the irregularity related to the operation of the store.

3.     Ecommerce.legal undertakes to consider complaints within 14 days.

4.     Ecommerce.legal allows you to join the Newsletter list and conclude a contract for the provision of digital content in the form of a Newsletter.

5.     Concluding a contract requires completing and submitting a form, including providing an email address and accepting the Terms and Conditions and Privacy Policy. The contract is deemed concluded upon receipt by the user of an email confirming their subscription to the Newsletter.

6.     The content contained in the Newsletter is subject to copyright protection. It is prohibited to copy, record, or distribute it without the consent of Ecommerce.legal.

7.     Sending illegal content via the form is prohibited.

8.     A trader with consumer rights may withdraw from a contract for the supply of digital content within 14 days of its conclusion, without giving any reason, by notifying Ecommerce.legal. Regardless of this, the user may unsubscribe from the newsletter at any time.

9.     Ecommerce.legal is liable for the lack of conformity of the performance with the contract towards the Entrepreneur under the rights of a consumer under the principles specified in the Consumer Rights Act and in the Regulations.

 

§ 9. Personal data protection

1.     The administrator of Customers' personal data collected via the Online Store is Ecommerce.legal.

2.     The principles of processing the personal data of Customers and Users are included in the Privacy Policy available on the website ecommercelegal.pl.

 

§ 10. Opinions

1.     When submitting reviews, ecommerce.legal verifies reviews of services and implements appropriate solutions to assess their authenticity. Once a review is submitted, it is verified. If it turns out that the data contained in the review cannot be linked to the order for the service that was the subject of the review, the review is deleted. If there are doubts about the authenticity of the review, these are clarified based on the submitted proof of purchase of the specific service.

2.     We publish all opinions (both positive and negative) and do not interfere with their content, nor do we offer additional benefits related to leaving or withdrawing an opinion.

3.     For the above reasons, we can assure you that the opinions available on the ecommercelegal.pl store website are verified and authentic and reflect actual shopping experiences.

4.     Reviews of the ecommercelegal.pl store may be posted on third-party websites. In the case of such reviews, the rules of those third parties apply to assessing the credibility and authenticity of the review. For its part, ecommercelegal.pl makes every effort to ensure that reviews of the store are always credible and authentic.

 

§ 11. User Content

1.     User Content is the following posted independently or via the Store by each User:

1)     opinions or comments about the store or products,

2)     additional information not required when placing an order, contained in the customer's account, posted independently or via the Store.

2.     The User may not publish content that constitutes illegal content within the meaning of the Digital Services Act (DSA) or is otherwise contrary to the law, these Terms and Conditions or good practice, in particular:

1)     content used to commit an offense or crime,

2)     content that infringes personal rights or copyrights,

3)     spam content,

4)     content used to conduct unfair competitive activities, including unauthorized marketing activities,

5)     content that is inconsistent with the subject matter of the website to which it relates.

3.     We may verify, block and remove illegal content while maintaining objectivity and due diligence.

4.     Reporting illegal content should include:

1)     a sufficiently substantiated explanation of why the person or entity in question alleges that the relevant information constitutes illegal content,

2)     indication, where possible, of the electronic location of the information, such as the URL and additional information enabling the identification of illegal content,

3)     name and surname or name and e-mail address of the reporting person or entity - except in the case of a report concerning information deemed to be related to one of the offences referred to in Articles 3 to 7 of Directive 2011/93/EU;

4)     a statement confirming the good faith belief of the person or entity making the report that the information and allegations contained therein are accurate and complete.

5.     If, as a result of verification undertaken on our own initiative or following a report, we determine that certain content is illegal, we may decide to block or remove it.

7.     Both the User who reported the content and disagrees with our decision and the User whose content we found illegal have the right to appeal the decisions regarding the content.

8.     Once you submit your appeal, we will promptly acknowledge receipt and review it within 14 days. Appeals will not be processed through automated means. We will provide a justification for our decision in accordance with all requirements under the Digital Services Act.

8.     You have the right to appeal content decisions through the contact point indicated in Section 13 below. Your appeal should include your name, contact information, and the reason for your request to change the decision.

9.     In the event of gross non-compliance with the provisions of this section and publishing illegal content, we may decide to temporarily block (suspend) or delete the account, as well as to limit the functionality of the account.

10.  Any decision regarding a user's account is subject to compliance with the principles of objectivity and due diligence. Such a decision may be appealed, but it will not be processed automatically. The appeal will be reviewed within 14 days, and the user will be immediately informed of the outcome.

11.  We are not responsible for any User Content if:

1)     we have no actual knowledge of illegal activity or illegal content and, in relation to claims for damages, we have no knowledge of facts or circumstances that clearly indicate illegal activity or illegal content;

2)     We will take appropriate action immediately to remove or disable access to illegal content upon receipt of such knowledge or information.

12.  If we have any information that gives rise to a suspicion that a criminal offence which threatens the life or safety of a person or persons has been, is being or may be committed, we will immediately inform the law enforcement or judicial authorities of the Member State or Member States concerned of our suspicion and provide all available information on the matter.

13.  We have established a contact point that serves to fulfill our obligations related to the Digital Services Act (DSA) and through which the relevant authorities and Users can communicate with us: biuro@ecommercelegal.pl Using the provided e-mail address, it is possible, in particular, to report content that the User considers illegal.

14.  None of the above provisions are intended to limit the User's rights and should not be interpreted as such.

 

§ 12. Final provisions

1.     All rights to the Store and the services offered, including intellectual property rights, property rights, and personal copyrights, belong to Ecommerce.legal. Without Ecommerce.legal's consent, it is not possible to reproduce or modify the content offered by Ecommerce.legal.

2.     Ecommerce.legal reserves the right to make changes to these Terms and Conditions for important reasons, such as changes in legal regulations. Ecommerce.legal reserves the right to change service prices and promotions without prejudice to agreements concluded before these changes.

3.     In matters not regulated in these Regulations, the generally applicable provisions of Polish law shall apply.

4.     None of the provisions of the Regulations are intended to limit the rights of the Entrepreneur as a consumer, guaranteed by the Consumer Rights Act and other legal acts.

5.     Ecommerce.legal agrees to submit any disputes arising in connection with the concluded contracts to mediation proceedings.
