Online store audit

Running an online store requires not only a refined product and good customer service, but also full compliance with legal regulations – from consumer protection, through GDPR, to information obligations, Omnibus and regulations regarding the sale of digital content.

A legal audit of an online store allows you to organize all these areas and identify potential risks before they develop into real financial or image-related consequences.

What is a legal audit of an online store?

An audit is a comprehensive analysis of e-commerce operations, aimed at verifying a store's compliance with applicable regulations and best market practices. It includes an assessment of documentation, purchasing processes, price presentation, disclosure obligations, and personal data protection, as well as the preparation of a detailed report with recommendations and a list of necessary changes.

As a result, the entrepreneur receives a clear picture of which elements require supplementation, what risks may occur in the store and how to adapt the business to the law in order to operate safely and in line with customer expectations.

What do we check during an audit?

The audit includes an analysis of all key elements of the store's operation:

1
Regulations and abusive clauses

We assess whether the documents contain any provisions that may violate consumer rights and expose the store to intervention by the Office of Competition and Consumer Protection.

2
The way prices are presented

We verify compliance with the Omnibus Directive, including the correct presentation of historical prices during promotions.

3
Returns and complaints

We analyze whether the store's policy meets the requirements of the Consumer Rights Act and whether the customer receives complete information about their rights.

4
Purchasing process

We verify that the purchase path provides the customer with all legally required information before finalizing the order. EU regulations require that the user completing the order be clear about their payment obligation. For this reason, the "Complete transaction" button cannot contain imprecise terms.

  • Phrases such as "I order", "Next" or "I confirm" do not meet the requirement of unambiguity.

  • Only buttons that directly indicate the obligation to pay are legal, such as: "I order and pay", "I buy with the obligation to pay", "I confirm the purchase and pay".

Failure to properly name the button may result in the sales contract being deemed invalid and the customer not being obliged to pay.

5
Information obligations

We assess the accuracy of content regarding delivery, payment, withdrawal from the contract, digital products, terms of use and contact.

6
GDPR and cookies

We verify the privacy policy, cookie banners, data processing bases, and compliance with the accountability principle.

7
Checkboxes

We verify the checkboxes provided because when placing an order, the customer must be able to express certain consents consciously and actively.

Incorrect use of checkboxes or their default selection may result in intervention by the Office of Personal Data Protection or the Office of Competition and Consumer Protection.

8
Mobile version

We analyze whether all information is equally readable and available in the mobile version of the store.

The aim is to identify both formal errors and elements that may pose a risk in relations with clients or supervisory authorities.

What documents do we prepare?

As part of the audit, we not only identify errors, but also prepare full legal documentation tailored to the store's operations:
1
Online store regulations

taking into account the rules of B2C and B2B sales, delivery conditions, complaints, opinions, digital content and newsletter.

2
Privacy and cookies policy

compliant with GDPR and cookie regulations, along with mechanisms for obtaining consent.

3
Content of information sections

clear and tailored texts regarding returns, complaints, consumer rights and basic rules of using the store.
