Control of the State Trade Inspection - e-commerce

The ecommerce.legal team was contacted by an entrepreneur running an online store, who had been the subject of an inspection by the State Trade Inspection. The notification precisely defined the scope of the inspection – it was to cover the legality of the business, the accuracy of price labeling and presentation, and the reliability of information provided to consumers .

It was clear from the outset that the inspection covered key areas of online sales, and any violations could have serious financial and reputational consequences. Our task was to prepare the client for the meeting with the inspectors in a way that avoided any risks and simultaneously used the inspection as an opportunity to further streamline sales processes .

We began with a detailed audit of the entire store interface . We paid particular attention to the way prices were presented and product labeling , as this is where businesses most often make mistakes. We also examined whether the practices in place were compliant with the latest requirements of the Omnibus Directive , including the principle of informing consumers of the lowest price in the last 30 days before the discount.

In parallel, we analyzed the client's internal documents —regulations, policies, and all consumer documentation. We wanted to ensure that all disclosure obligations under the law were properly met and that no objections would arise from the authorities. We also reviewed the entrepreneur's accounts on popular marketplaces, which, like the online store, may be subject to inspection by the Inspectorate.

During the inspection itself, we were in constant contact with the client , providing ongoing substantive support . We prepared explanations for the inspectors' questions and we sent additional information to the authority.

The inspection was completed with a positive result . No violations were identified . Furthermore, we provided the client with additional recommendations for further optimizing the way they present prices and communicate with consumers, ensuring their store is fully prepared for future legal changes, including full implementation of the obligations arising from the Omnibus Directive.

This case is another example of how proper preparation and legal support during inspections allow entrepreneurs not only to avoid sanctions, but also to organize their business processes and strengthen the security of their operations in the future.
