IP Scan - building awareness and security of intellectual property in e-commerce

by Marcin Tomczak on Jan 25, 2026

Introduction

A comprehensive intellectual property audit (IP Scan) is a tool that allows entrepreneurs not only to discover the potential of their assets, but also to avoid serious legal problems when expanding into new markets.

Intellectual property is often the most valuable element of e-commerce. However, many entrepreneurs are unaware of the scale of the threats and potential posed by trademarks, designs, domain rights, know-how, and technical documentation. Lack of appropriate agreements and disorganized IP management processes can lead to significant losses—both financial and marketing.

Case description

Our clients, owners of private labels and importers and distributors of foreign brands, were unaware of the scale of intellectual property threats to their businesses. There was a lack of confidentiality agreements, clearly separated marketing policies for private labels and third-party brands, and reliable documentation regarding the use of manufacturer materials. Businesses also failed to implement systematic infringement monitoring policies, which in practice prevented rapid response to threats and hindered the development of private labels.

Solution method

We offered our clients the IP Scan service – a comprehensive diagnostic of a company's intellectual assets, performed by experienced experts registered with the Polish Patent Office. The service includes a detailed assessment, resulting in a report covering the current state of the IP as well as recommendations for development, protection, and the elimination of identified threats.

We highlighted the need to separate the sale of proprietary and third-party brands, streamline documentation, and implement key agreements, particularly NDAs (Non-Disclosure Agreements). We also highlighted the importance of internet domains and the risks resulting from a lack of control over these assets in foreign markets. All reports were prepared in accordance with the office's stringent formal requirements, enabling clients to obtain reimbursement for the service.

Conclusions

As a result of IP audits, entrepreneurs gained a comprehensive overview of their assets and implemented systematic intellectual property management policies. This not only increased legal security but also built the potential for further expansion through conscious management of brands, documentation, and know-how.

Summary

IP Scan is a key tool for building a competitive advantage and minimizing risk in e-commerce, especially for companies considering international expansion. A comprehensive approach to intellectual property management increases company security, facilitates the implementation of new products in foreign markets, and effectively protects business interests.
